The K-1 Visa Process
A K-1 visa is a non-immigrant visa that allows U.S. citizens to bring their fianc(e)s to the United States. It is a temporary visa that is valid for only 90 days, and it is intended to be used as a precursor to applying for a fianc(e) visa, the K-1 visa is a necessary first step.
The K-1 visa requires the couple to have met in person at least once in the previous two years. If the couple has not met in person, they will need to go through a different process, known as a fiance visa, that is more complex and lengthy.
Once the K-1 visa is approved, the foreign fianc(e) will be able to enter the United States and marry their U.S. citizen fianc(e) within 90 days. They will then need to apply for a different visa, the adjustment of status, which will allow them to stay in the United States permanently.
When the K-1 visa process is complete, the couple will be married, and the foreign fianc(e) will be able to apply for a permanent resident visa, the green card, which will allow them to stay in the United States permanently. If the couple decides to divorce, the foreign fianc(e) will be required to leave the United States within the 90-day period.
