I am a war veteran. I initially filed a pro-se fiancé visa for my then fiancé, who resided in China. My initial fiancé visa was approved by the Service Center but when my fiancé appeared for a visa interview, they denied her fiancé visa application. I was extremely disappointed. I cannot thank Amit Dehra enough! I was told by many prominent Immigration Attorneys that I an ineligible to obtain a U.S. green card in the U.S. because I entered the country illegally. However, what all immigration attorneys, except Attorney Amit Dehra, failed to ask me was if, “I was the Beneficiary of any petition filed on or before April 30, 2001.” This was the specific question asked my Attorney Amit Dehra and I said “yes”. After carefully reviewing the documents, I was informed that I am eligible to adjust in the U.S., despite the fact that I entered illegally in the U.S. I was told that I am a beneficiary under section 245(i) of the Immigration and Nationality Act. We filed paperwork and I was interviewed by the Service. The interview went well andAttorney Amit Dehra informed the Service how I qualified under 245(i) of the Act and my green card case was approved. Today, I am a green card holder. My case is a classic case where, unknown to me, there was a final order of deportation against me for the last 10 years. I voluntarily took the polygraph test which reiterated our position that I did not receive the NTA and any Immigration hearing date. I do not know where to start from. I retained Attorney Amit Dehra to help me in obtaining a fiancé visa for my fiancé. My fiancé does posses dual nationality.Dehra Miotke filed the appropriate paperwork with USCIS and after the case was approved it was forwarded to the Consulate for visa interview in a timely fashion. Shockingly, at the time of visa interview, the Consulate denied the visa to my fiancé stating that she had been previously removed from the U.S. and hence require Form I-601 “extreme hardship” waiver. My fiancé and I were disappointed for two reasons: One, per the information of the Consulate, it takes many months and two, the approval is entirely discretionary. I have a very interesting story to share! Once of my distant relative, who was a client of Attorney Dehra took me for a legal consultation.
